Seven Supreme Court justices told the United States Postal Service it was out of time. Justice Brett Kavanaugh, appointed by President Trump, wrote that the rule may well be lawful and that the county clerk still cannot put it in place by November 3. A court can be out of time. A law never is, and that is the point of this segment.
Jenny Beth Martin tells the story of where the SAVE America Act came from. She and Cleta Mitchell of the Election Integrity Network were on a coalition conference call with Senator Mike Lee about Arizona, and she asked him to write a bill to fix it. The problem started in 2013, when the Supreme Court told Arizona it had to accept the federal voter registration form, while noting that Congress could change that law.
Arizona's answer was two ballots. Show proof of citizenship when you register and you vote the whole way down the ballot. Do not show it, and you still vote for president, Senate and Congress. That is the loophole the bill closes, and seventy eight percent of voters say you should have to prove citizenship before you register.
While the bill sits in the Senate, the cases arrive. A citizen of Peru was arrested in Kansas for voting in 2024. A Mexican national was indicted in Harrisburg, Pennsylvania on three counts. Neither was charged until 2026, two years after the winners were sworn in. That is why poll watchers and poll workers matter more this year, not less.
