On Friday the Justice Department charged 16 people in seven states with voting in elections they had no right to vote in, eight of them noncitizens living in Texas. Prosecutors found most of the cases years after the ballots were counted, while looking at something else. Jim Pfaff, president of The Conservative Caucus and former chief of staff to two members of Congress, tells guest host Robert McNeily what that timeline reveals: the front end of registration has been stripped of citizenship checks, and the back end is being hidden from the people who could run them.
Pfaff traces the problem to the motor voter laws of the 1990s. They passed when every state required proof of citizenship for a driver's license, so a registration at the license branch carried a citizenship check with it. Then states loosened the license requirements while pushing registration at those same counters harder than ever, and New Jersey's more than 6,000 noncitizen registrations are the result. On the back end, he says the federal government holds better citizenship records than most states, the law already requires states to hand over voter records when the Justice Department asks, and Democrat-run states are refusing.
