Delilah's Law: A 2019 Loophole Put Illegal Aliens in 80,000-Pound Trucks | Shannon Everett

Delilah's Law would close the 2019 loophole that put untrained illegal alien truckers in 80,000-pound rigs on American highways. Shannon Everett explains why it is stalled.

A 2019 federal guidance change let asylum applicants holding only a work permit apply for a commercial driver's license. Self-certified CDL schools handed out credentials with little or no training, self-certified electronic logs from overseas manufacturers provided no real oversight, and the freight brokers who loaded those drivers claimed immunity when the crashes came. Shannon Everett of American Truckers United walks guest host Robert McNeely through how the trucking industry got here, what Secretary Sean Duffy's non-domiciled CDL rule fixed and what it left on the road, and why Delilah's Law (H.R. 5688) cleared the House Transportation and Infrastructure Committee in March and has not had a floor vote since.

Guest: Shannon Everett, American Truckers United. Guest host: Robert McNeely, in for Jenny Beth Martin.

Today's topics:
• What Delilah's Law (H.R. 5688) would do: restrict non-citizen CDL eligibility, require English proficiency, verify identity and immigration status, and tighten enforcement
• The 2019 FMCSA guidance change that let employment authorization card holders apply for a CDL, and how it exploded after 2021
• Secretary Duffy's rule closed the door on new non-domiciled CDLs but never revoked the ones already issued. Delilah's Law requires recertification within 12 months
• Self-certified CDL schools and self-certified electronic logging devices built in Serbia, India, and China
• Drivers working 20-hour days and 80,000-pound trucks running into stalled traffic
• The Supreme Court's unanimous May ruling that freight brokers can be held liable for negligently selecting a carrier
• Deanne Miller of Colorado, her husband Scott, and the driver who had entered the country 16 times
• Why no criminal statute exists for an unlicensed, untrained driver who takes a life
• Reciprocity: why states should stop honoring non-domiciled CDLs issued by California and New York
• The Mexican CDL loophole, and why Texas leads the nation in English proficiency violations
• The math: transportation is 2 to 3 percent of a load's cost, so the cheap labor saves shippers about half of one percent
• There is no driver shortage. There is an abuse of drivers' time at the docks
• The appeals court ruling on the Duffy rule that could drop any day
