The federal government flagged about 20,000 California mail ballots as likely cast by noncitizens, and the Justice Department asked the Ninth Circuit to stop the state from counting them. On Monday, one week before Election Day, the court said no, two to one, and sent the case back to the district court. Jim Pfaff, president of The Conservative Caucus, tells guest host Robert McNeily what that ruling did and did not decide: the judges never reached the merits, they said the case had come up the wrong way, and the Justice Department is pushing because the clock runs out in seven days.
Pfaff's larger point is that the 20,000 are the tip of the iceberg. He puts the number of people improperly on California's rolls at more than a million, between noncitizens and voters who moved, and says a state with messy rolls, universal mail ballots, no chain of custody, and unlimited ballot gathering does not hold elections so much as selections. Asked whether the failure is in the courts or in a Congress that never gave anyone an enforcement tool, he answers that the tool already exists: a 1990s federal law lets the Justice Department request voter rolls, and the states are refusing to let it work. Article I gives states the first word on elections and Congress the power to regulate them, which it has done since the Civil Rights Act. The SAVE America Act, he says, would tie those loose ends together and restore the election system America ran for two centuries.
In this segment:
• What the two-to-one ruling actually decided
• More than a million improperly registered in California, by Pfaff's estimate
• The enforcement tool from the 1990s that the states are refusing to honor
• Motor voter, automatic registration, and what the SAVE America Act would restore
Tell your senators to pass the SAVE America Act: 202-224-3121.
