Last Thursday a federal judge appointed by President Biden threw out a case against a woman charged with voting as a noncitizen in 2020, ruling that the Constitution leaves voter qualifications to the states and that the 1996 federal ban on noncitizen voting goes beyond what Congress may do. On Monday the Justice Department announced charges against 16 foreign nationals in four states for voting in our elections or swearing they were citizens so they could. And on December 8 the Supreme Court hears the Arizona case in which the left argues the states cannot keep noncitizens off their voter rolls either. If Congress cannot stop it and the states cannot stop it, who makes sure only American citizens decide American elections?
Jenny Beth Martin spends the full hour with Cleta Mitchell, founder and chairman of the Election Integrity Network, which trains citizen volunteers across the country and publishes the Model Election Laws Handbook that legislators use to write election law. 28 days before Election Day, they go through what her volunteers are seeing on the ground, the voter rolls, the December 8 Supreme Court case, mail ballots and nursing homes, the voting machines, and what you can do in the next four weeks.
Guest: Cleta Mitchell, Founder and Chairman, Election Integrity Network
Today's topics:
• The ruling: Judge David Leibowitz says the 1996 federal ban on noncitizen voting goes past what Congress is allowed to do, and the Trump administration has filed an expedited appeal
• 16 foreign nationals charged with election crimes in Florida, Louisiana, Wisconsin and Minnesota, 10 of them in Minnesota alone
• What Cleta Mitchell's volunteers are seeing in the states 28 days out, and how this October compares to October 2024
• The declassified election documents: what the government found, and what it says it did not find
• The voter rolls: the 90-day rule, the ERIC voter data group, the federal SAVE citizenship check, and why every citizen should get a copy of their county's rolls
• December 8 at the Supreme Court: Republican National Committee v. Mi Familia Vota, and how the SAVE America Act began on a January 2024 call with Senator Mike Lee
• Mail ballots, military voters and nursing homes: the Medicare and Medicaid memo on resident voting rights and the family toolkit built around it
• The machines and the count: hand-marked paper ballots, poll watchers, and Georgia's October 15 voting-equipment decision
• How the states grade: Mississippi 83, Nevada 30, and Michigan's Only Citizens Vote petition that came up 3 signatures short in a sample of 1,000
• Your assignment: sign up to work the polls at helpatthepolls.com, call the nursing home where your mom or dad lives, and stand with us at the Supreme Court on December 8
