Nursing home voting is where some of the ugliest ballot harvesting happens, and Cleta Mitchell, founder and chairman of the Election Integrity Network, says it happens over and over again. Partisan groups go into nursing homes, group homes and shelters, register the residents, and harvest their ballots, and the residents may not even realize they are voting. After every election she hears the same call: somebody got my mother to vote, and she has had Alzheimer's for ten years.
In July the Centers for Medicare and Medicaid Services, under Dr. Mehmet Oz, issued new guidance replacing the Biden-era rules. Residents who are competent and want to vote keep that right; they also have the right not to vote and not to have a ballot cast in their name. A resident's family or personal representative must be notified if a loved one's registration or voting status changes, and can file a complaint the facility has to publish, even after the election. The Election Integrity Network built a toolkit to put that guidance to work, and Jenny Beth Martin walks through where to find it at electionintegritynetwork.org, including the page for families.
Mitchell closes with what Virginia's new Democratic trifecta is proposing: a separate court proceeding before a person already declared incompetent can lose the right to vote. In her view it has one purpose, to make it harder to prosecute the people who vote in those residents' names.
