Tuesday night, in two states 900 miles apart, Americans got two different answers on the same question. In Oklahoma, voters themselves wrote photo identification into the state constitution, so no future legislature can take it back with a simple majority vote. In Ohio, a federal judge appointed by President Bill Clinton blocked the state from requiring proof of citizenship at motor vehicle offices, 39 days before Ohio's voter registration deadline.
Jenny Beth Martin and co-host Robert McNeely work both of them through, and then Jenny Beth Martin tells the part of this story almost nobody has heard: where the SAVE America Act, the Safeguard American Voter Eligibility Act, actually came from. It began on a coalition conference call with Senator Mike Lee, where Cleta Mitchell was describing what was happening in Arizona. Arizona passed a statewide referendum requiring proof of citizenship to register to vote. It was challenged, it went to the Supreme Court, and the Court held that the state still had to accept registrations made under the National Voter Registration Act, the motor voter law. What Arizona ended up with is a bifurcated ballot: show proof of citizenship and you vote all the way down to precinct committeeman; do not show it and you still vote for president, Senate and Congress. Closing that loophole is the whole point of the bill.
Then the courts again. The Supreme Court issued a six to three ruling on August 24 allowing President Trump to proceed with key portions of his executive order restricting mail-in ballots ahead of the November midterms. It lifted a lower court injunction without ruling on the order's underlying legality, and 23 states and the District of Columbia turned around and sued again two days later.
In the second half, Stacy Washington joins. California Proposition 40 would put a one-time 5 percent tax on the assets of the state's billionaires, and she explains why taxing net worth means taxing a number that moves every day. Senator Josh Hawley has written to the chief executive of Flock Safety over what he calls an unprecedented national surveillance network: more than 120,000 cameras in 49 states, scanning 20 billion vehicles a month, with the company's own internal policy as the only thing standing between that data and anyone who wants it. Nobody ever put it to a vote. And Congresswoman Alexandria Ocasio-Cortez rejoined the Democratic Socialists of America, which confirmed her membership.
