Foreign Money in Elections: The Loophole That Reached 26 States | Jason Snead

It is illegal for foreign nationals to fund American candidates. It is not illegal to fund the ballot measures that rewrite state law.

Congress built the firewall decades ago and it works exactly as intended: a foreign national cannot give to a candidate for American office or to a political action committee. The reasoning was never complicated. If you are running for office, you should answer to American voters and not to somebody overseas with interests of their own.

Jason Snead of the Honest Elections Project explains the part Congress never covered. A ballot measure is not a candidate. A constitutional referral from a state legislature or a citizen initiative is treated as part of a state legislative function, and the federal ban does not reach it. Almost every state has some form of these measures, at least at the local level.

So here is what came through the gap. The Sixteen Thirty Fund, one of the biggest backers of left wing ballot campaigns in the country, has taken roughly 300 million dollars from a Swiss billionaire. He is not an American citizen. Snead says he has stated he never wanted to be one. Over the same stretch, the fund spent 130 million dollars driving ballot measures in 26 states, rewriting state election law, abortion law and minimum wage law.

Ohio in 2024 is the case study. The money went after control of the state's redistricting process, which Snead says could have flipped three to six congressional seats and with them the House of Representatives. Ohio lawmakers passed the first ban on foreign money in ballot campaigns, and every Democrat in the Ohio legislature voted against it, in a special session that had been called partly to keep their own presidential nominee on the state ballot. Then attorney Marc Elias sued to overturn the law.

Ten more states have passed a version of the ban since Ohio. Snead wants all fifty.
