The Constitution never says nine justices. Congress set that number, Congress has moved it before, and it has held at nine since 1869 on nothing but restraint. This week the House of Representatives had one chance to write nine into the Constitution and take court packing off the table for both parties, permanently. Congressman Andy Biggs of Arizona introduced the amendment. It is one sentence long. It failed 212 to 206, with every Republican voting yes and 205 Democrats and the House's one independent voting no. Congressman Jim Clyburn wants 13 and calls it a baker's dozen. Kamala Harris has said the country needs to revisit expanding the Court. Nobody on that side answers the obvious question: if nine is not enough, why is 13?
The day before, the same House voted 220 to 192 to condemn socialism and to call for the enactment of the SAVE America Act — the Safeguard American Voter Eligibility Act, which requires proof of citizenship before a person registers to vote. Within about a day, a caucus inside the Democratic Socialists of America answered with a membership sign-up link and almost 3,000 likes, the Portland chapter answered by quoting the Communist Manifesto, and a movement magazine reported the New York City chapter has grown from about 5,900 members to more than 15,000.
