Sanctuary New York: 16,070 ICE Detainers Refused. What a Detainer Actually Is | Rosemary Jenks

Sanctuary New York refused 16,070 ICE detainers covering more than 52,000 criminal charges. Here is what a detainer is, and why the jail is safer.

The Department of Homeland Security says the State of New York has refused 16,070 requests from ICE to hold someone in jail, and that those people carry more than 52,000 criminal charges and convictions between them. Before the argument about sanctuary states, Jenny Beth Martin asks Rosemary Jenks of the Immigration Accountability Project to explain the thing itself, and the explanation is the argument.

A detainer is a formal request from ICE to a local jail or state prison to hold an alien already identified as deportable for up to 48 hours past his scheduled release, so ICE can come and get him. The jail is where ICE verifies who is here legally and who is not, and it is the safest place for a pickup for everyone: the man is unarmed, in a secure facility, with no family members or bystanders in the way. When a governor or a mayor refuses the detainer, that same person walks out the door, and the pickup happens later, in a workplace or a home, where it is more dangerous for the officers, for the alien, and for everyone around them. Jenny Beth adds that the jail transfer is also the more respectful option: nobody is surprised at home.

Then the workaround. Federal law lets any state official, a governor, an attorney general, a sheriff, or a state prison chief, sign a 287(g) agreement directly with ICE, with or without the governor's blessing. California and Maryland have passed laws prohibiting their officials from cooperating, and in both states a sheriff is suing. Under this administration, Jenks says, 287(g) agreements have exploded into the thousands.

Guest: Rosemary Jenks, co-founder and policy director of the Immigration Accountability Project, who testified before the House Judiciary Committee in September on what Congress must do to make the Trump border policies permanent.
